    Assistant Tribal Attorney

    ​GENERAL DESCRIPTION OF DUTIES

    The Assistant Tribal Attorney (ATA) shall work under and at the direction of the Director of Legal Division-Tribal Attorney (DLD-TA). The ATA will represent the interests of the Menominee Tribal Government, the Menominee Tribal Administration, the Menominee Tribal programs and other Menominee Tribal government/programmatic interests as directed by the DLD-TA.

    EXAMPLES OF ESSENTIAL FUNCTIONS

    This list is illustrative and not exhaustive.

    •Represent the Menominee tribal government, Menominee tribal programs, and other Menominee tribal governmental/programmatic interests as directed by the DLD-TA.

    •Provide legal interpretation in matters concerning Menominee tribal government, Menominee tribal programs or other Menominee tribal governmental/programmatic interests, as directed by the DLD-TA.

    •Provide advice and recommendations to the Menominee tribal government, Menominee tribal programs or other Menominee tribal governmental/programmatic interests, as directed by the DLD-TA.

    •Draft and review Menominee tribal resolutions and ordinances, as directed by the DLD-TA.

    •Review and draft contracts, agreements, memorandums of understanding and other legal documents, as directed by the DLD-TA.

    •Appear and represent the interests of the Menominee tribal government or tribal programs before tribal, state and federal courts, administrative tribunals and other judicial or quasi-judicial bodies, as directed by the DLD-TA.

    •Draft and review civil and administrative pleadings on behalf of the Menominee tribal government, Menominee tribal governmental programs and other Menominee tribal governmental/programmatic interests, as directed by the DLD-TA.

    •Litigate on behalf of the Menominee tribal government and Menominee tribal programs in tribal, state, and federal courts, or administrative bodies/quasi-judicial bodies, and defend the same as directed by the DLD-TA.

    •Attend legislature meetings, and committee meetings in the absence of the DLD-TA and as directed by the DLD-TA.

    •Perform any other duties and responsibilities as delegated by the Director of Legal Division.

    •Perform related duties as directed by the DLD-TA.

    ​Additional requirement: must follow, in additional, all terms, duties and/or responsibilities described in assistant attorney contract.

    MINIMUM TRAINING AND EXPERIENCE

    To be considered for an interview for this position, applicants shall pass the all following minimum qualifications.

    1. A Juris Doctor degree from a US accredited law school.

    2. Admitted to practice and in good standing with the Wisconsin Supreme Court (Wisconsin State Bar).

    3. One (1) year of legal experience working for an Indian Tribe, or a firm representing Tribal interests, or three (3) years of legal experience in the active practice of law with litigation experience, or other legal experience involving Indian law or related areas.

    4. Must have proven good past work record evidenced by favorable references from past employers. If no past employer, then letter of reference from either one Wisconsin State Court Judge or two attorneys admitted to practice in the State of Wisconsin.

    5. Must have a good academic law school recorded evidenced by law school transcripts.

    To assist in the screening process, applicants must address their specific qualifications as they relate to the above qualifications at the time of application, through the Menominee Tribal application form as may be supplemented by resume and/or cover letter. Applicants who fail to adequately address the above minimum qualifications at the time of application will be screened out and will not be given an interview for the position. Applicants must provide law school transcripts, letter of good standing with the Wisconsin Supreme Court, letters of reference and three writing samples (not to exceed 15 pages total) with their completed application. If applicant is selected for an interview, applicant may be required to give a presentation and take a written exam at the time of the interview.

    SPECIAL REQUIREMENTS

    Candidates selected for hire must pass a drug test and employment will be contingent upon results of said test.

    • Must qualify, obtain certification of admission and maintain certification of admission to the Menominee Tribal Bar.

    • Must maintain certification of admission to the Wisconsin State Bar.

    • Must possess valid Wisconsin Driver's License and a reliable vehicle; must have vehicle liability insurance.

    • Must be able to travel as required.

    • Must successfully pass a background investigation and reference check with past employers.

    • Must possess excellent demonstrated written and verbal communications skills.

    • Must be able to present law, facts and arguments clearly and in written and oral format.

    • Must be able to type and possess necessary computer skills as may be determined by a skills test.

    • Must be able to do legal research through LexisNexis or other related computerized legal research providers.

    • Successful candidates will be required to enter into an employment contract with the MITW.

    • Successful candidates will be required to follow terms of their employment contract and applicable terms of the Policies and Procedures of the Menominee Indian Tribe of Wisconsin

    Data Utilization: Requires the ability to perform upper level data analysis, including the ability to hypothesize, theorize and assimilate, to modify or adapt existing policies/methods to meet unusual conditions within the context of existing theories and management principles.

    Human Interaction: Requires the ability to apply principles of negotiation. Performs such in formal situations within the context of legal guidelines.

    Equipment, Machinery, Tools, and Materials Utilization: Requires the ability to operate, maneuver and/or provide simple but continuous adjustment on equipment, machinery, tools, and/or materials used in performing essential functions.

    Verbal Aptitude: Requires the ability to utilize consulting and advisory data and information, as well as reference, descriptive and/or design data and information as applicable.

    Mathematical Aptitude: Requires the ability to perform addition, subtraction, multiplication, and division; ability to calculate decimals and percentages; may require ability to utilize principles of fractions and/or interpret graphs.

    Functional Reasoning: Requires the ability to apply principles of logical or synthesis functions involving planning and directing of interrelated activities or multiple departments. Ability to deal with several concrete and abstract variables in working out approaches to major problems.

    Situational Reasoning: Requires the ability to exercise the judgment, decisiveness and creativity required in situations involving the direction, control and planning of an entire program or set of programs.

    BEHAVIORAL EXPECTATIONS

    Must be able to work in a properly collegial relationship with co-workers. Must be able to interact with other departments within the Tribe in the spirit of compromise. Must be able to take on additional responsibilities in a spirit of cooperation and teamwork. Must be able to maintain an atmosphere of trust, fairness and respect and be mutually supportive with co-workers. Must be able to maintain strict confidentiality.
