Reinstatement of Carlos Gamiño
On June 15, 2011, the Wisconsin Supreme Court reinstated the law license of Carlos Gamiño and ordered him to pay the $7,827.83 cost of the reinstatement proceeding. Disciplinary Proceedings Against Gamiño, 2011 WI 42.
In 2008, the court had suspended Gamiño’s law license for 18 months after determining he committed five counts of misconduct while handling a family law matter in which he failed to obtain information essential to ensure an equitable division of property in a divorce. After a hearing on Gamiño’s reinstatement petition, a referee concluded that Gamiño had met the standard for reinstatement set forth in SCR 22.31(1) and recommended that Gamiño’s license be reinstated. After reviewing the record, the court adopted the referee’s recommendation and concluded that Gamiño had satisfied all criteria necessary for reinstatement. The court noted, however, that Gamiño had been suspended twice and publicly reprimanded once in the last five years for misconduct that included, among other things, misrepresentation, improper sexual relationships with female clients, failure to act with reasonable diligence, and failure to refund unearned fees. In view of Gamiño’s disciplinary history and concerns about his attention to detail, the court imposed the condition that Gamiño be supervised, by a licensed attorney who is not a member of Gamiño’s family, for two years following his reinstatement. The supervising attorney must file quarterly reports with the Office of Lawyer Regulation (OLR).
Hearing to reinstate Jimmie Davison
A public hearing will be held at 9 a.m. on Oct. 6, 2011, before referee Lisa Goldman at the offices of Lawton & Cates, 10 E. Doty St., Suite 400, Madison, on the petition of Jimmie Davison, Fitchburg, to reinstate his Wisconsin law license. Any interested person may appear at the hearing and be heard in support of, or in opposition to, the reinstatement petition.
In 1993, the supreme court revoked Davison’s Wisconsin law license. Davison’s misconduct related to his having been found guilty of first-degree sexual assault of a child. Davison’s conduct reflected adversely on his honesty, trustworthiness, or fitness as a lawyer.
In 2010, the supreme court denied a reinstatement petition that Davison filed in 2007.
To be reinstated, Davison has the burden of substantiating by clear, satisfactory, and convincing evidence that 1) he has the moral character to practice law in Wisconsin, 2) his resumption of the practice of law will not be detrimental to the administration of justice or subversive of the public interest, 3) all his representations in his reinstatement petition are substantiated, and 4) he has complied fully with the terms of the order of suspension or revocation and with SCR 22.26.
