    Supreme Court Orders

    The Wisconsin Supreme Court has amended SCR Chapter 72, creating a rule prescribing procedures for the clerk of court to follow when required to expunge a record.

    Expunction of court records

    In the Matter of the Amendment of Supreme Court Rules:
    SCR 72.06 - Expunction of Court Records

    Order 97-07

    The court held a public hearing Oct. 21, 1997, on the petition of the Supreme Court's Records Management Committee proposing the creation of a rule prescribing procedures for the clerk of the court to follow when a statute or court order requires that a court record be expunged. The court has considered the petition and the presentation at the public hearing by the Records Management Committee.

    IT IS ORDERED that, effective the date of this order, the Supreme Court Rules are amended as follows.

    1. SCR Chapter 72 (title) is amended to read:

    SCR Chapter 72 (title) Retention and Maintenance of Court Records.

    2. 72.06 of the supreme court rules is created to read:

    72.06 Expunction.

    When required by statute or court order to expunge a court record, the clerk of the court shall do all of the following:

    (1) Remove any paper index and nonfinancial court record and place them in the case file.

    (2) Electronically remove any automated nonfinancial record, except the case number.

    (3) Seal the entire case file.

    (4) Destroy expunged court records in accordance with the provisions of this chapter.

    IT IS FURTHER ORDERED that notice of these amendments of the Supreme Court Rules shall be given by a single publication of a copy of this order in the official state newspaper and in an official publication of the State Bar of Wisconsin.
