Judicial commission ends case against Justice Gableman

July 8, 2010 – The Wisconsin Judicial Commission has issued a “Statement of Discontinuance” in the disciplinary proceedings against Wisconsin Supreme Court Justice Michael J. Gableman.

The judicial commission, which investigates and prosecutes allegations of judicial misconduct, instituted proceedings in 2008 regarding a possible violation of Supreme Court Rule 60.06(3)(c) concerning campaign conduct and rhetoric. The proceedings stemmed from a 2008 television advertisement that aired during Gableman’s campaign.

In its statement of discontinuance, the judicial commission noted the supreme court’s inconclusive resolution of the case and a lack of legislative authority to continue prosecution.

The judicial commission also issued a press release explaining its position.
