    With the school year fast-approaching, lawyers will be busy fielding questions from school districts and parents. Jeff Spitzer-Resnick discusses the legal issues with reopening plans and a recent decision on the constitutional right to literacy.

    Aug. 5, 2020 – With the school year fast-approaching, lawyers will be busy fielding questions from school districts and parents. In this video, Jeff Spitzer-Resnick discusses the legal issues with reopening plans – especially for students with disabilities – guidance from the state, and a recent decision on the constitutional right to literacy. Spitzer-Resnick is an attorney and advocate at Systems Change Consulting.

    He says the state has no directives on school reopening plans, so each school district in Wisconsin must make reopening decisions. “They have to figure it out for themselves,” he said. “And you are on your own in an unprecedented and difficult time.”

    Spitzer-Resnick noted a federal special education law that applies to children with disabilities. “Those laws remain unchanged” he said. “There have been no waivers, no amendments. Those poses a very difficult educational and legal question.”

    Spitzer-Resnick also discusses a decision from the Sixth Circuit on the constitutional right to literacy, and other issues lawyers will be dealing with this school year.
