    Hearing to Reinstate Robert T. Malloy

    A public hearing will be held on the petition of Robert A. Malloy, Milwaukee, to reinstate his Wisconsin law license.

    A public hearing will be held on Wednesday, Aug. 28, 2018, at 9 a.m., before Referee Dennis J. Flynn at Loeb & Herman S.C., 111 E. Wisconsin Ave., Suite 1900, Milwaukee, on the petition of Robert A. Malloy, Milwaukee, to reinstate his Wisconsin law license. If a second day of testimony is necessary, the hearing will continue at 9 a.m. on Aug. 29, 2018 at the same location. Any interested person may appear at the hearing and be heard in support of, or in opposition to, the petition for reinstatement.

    The Wisconsin Supreme Court suspended Malloy’s license for one year, effective June 10, 1997.  Disciplinary Proceedings Against Malloy, Sup. Ct. Case No. 96-1300-D. Malloy’s suspension was based on his mishandling client funds and commingling funds, failing to keep required trust account records, failing to respond to requests from clients for information concerning their matters, failing to file or pursue legal matters, failing to promptly refund unearned retainers, and failing to cooperate with the Board of Attorneys Professional Responsibility in its investigations.

    The supreme court later suspended Malloy’s license for an additional three months, commencing June 10, 1998. Disciplinary Proceedings Against Malloy, 212 Wis. 2d 649, 568 N.W.2d 638 (1997).  Malloy’s suspension was based on his failing to act with reasonable diligence and promptness in representing clients, failing to return unearned fees upon termination of representation, failing to promptly comply with reasonable requests for information, and failing to respond to the Board of Attorneys Professional Responsibility in its investigations.

    To be reinstated, Malloy has the burden of substantiating by clear, satisfactory, and convincing evidence that he has the moral character to practice law in Wisconsin, his resumption of the practice of law will not be detrimental to the administration of justice or subversive of the public interest, all of his representations in his reinstatement petition are substantiated, and he has complied fully with the terms of the orders of suspension and with SCR 22.26.
