    Final Order 22-05 and Amended Final Order 22-05: Supreme Court Rules Related to Electronic Banking

    On July 15, 2022, the Office of Lawyer Regulation (OLR) filed a rule petition asking the court to amend SCR 20:1.0 and SCR 20:1.15 to permit electronic transactions in lawyer trust accounts. The OLR explained that Wisconsin is the only state that prohibits electronic transactions in lawyer trust accounts. The OLR asserted that the revisions will permit electronic transactions with sufficient procedural safeguards to protect the public.

    Written comments were submitted from various stakeholders and a public hearing was held on Feb. 24, 2023. Following the public hearing, and in response to questions for the court, the OLR submitted an additional revision to one of the proposed changes.

    At the ensuing closed administrative rules conference, the court voted to grant the petition, as amended, and to revise the rules as requested.

    ORDER ISSUED: March 14, 2023

    DISPOSITION: Petition granted as amended, effective July 1, 2023.
