As a result of the enactment of 2009 Act 94, the Wisconsin Indian Child Welfare Act (WICWA), the State Public Defender (SPD) now is authorized to represent parents (and Indian custodians) of Indian children in CHIPS and (most) JIPS cases (IW-1720 and IW-1724). The parents (if 18 or older) will need to complete the eligibility form; they are not automatically SPD-eligible. Please note that this appointment authority is a narrow exception to the prohibition, enacted in 1995, of SPD appointments of counsel for parents in CHIPS and JIPS cases.
Therefore, if you have a protection/services (CHIPS or JIPS) case under WICWA, please advise the parent or Indian custodian of an Indian child of the right to apply to SPD for appointment of counsel.
