Classic movie buffs may recognize this exchange from An Affair to Remember when Carey Grant’s character answers the question, “What makes life so difficult?” with one word, “People.”

While his response was somewhat flippant in the midst of a serious conversation, it rings true for anyone who’s had to work with a constantly frustrating person (client or coworker). Sometimes, dealing with difficult people can drain your energy more than actual tasks.

So, what can you do about it?

While they seek attention, try seeking intention. Do your best to think about why they may be uncooperative or acting out. Is there something you can do to alleviate their concerns so they’ll work with you? Also, share your intentions with them. They might be getting defensive because they’re misunderstanding the circumstances.

Keep your cool. Losing your temper is a quick way to lose control of the situation. Your ability to stay calm in the midst of their storm displays an unshakable quality that can grab their attention and earn you the respect of your colleagues.

Show respect. Always speak with respect. Name calling or belittling are obvious no-nos, but make sure you’re not being condescending or patronizing. While talking down to anyone is never a good idea, talking down to a
difficult person is a recipe for escalation.

Change the subject. Sometimes people want to dwell so long on what’s wrong that they should put up a tent and sleep there. Take control of these negative conversations by simply changing the subject. Ask questions about the new topic to keep the dialogue progressing in a more constructive way.

If you’re having trouble dealing with difficult people at work (or at home), check out these insightful articles for more advice.

What would happen to your practice if you became incapacitated? Do you or your organization have a method in place for transferring your clients to someone else? Having a successor is an important part of ethical practice.

The State Bar’s new Succession Planning Registry can help you ensure that your clients’ matters will not be neglected – and your family will not be burdened – if you die or become incapacitated while practicing. The Succession Planning Registry allows you to name your successor with the State Bar. Judges, clients, and others can submit a request for the name of your successor if necessary.

To register your successor:

Log in to WisBar.org

Select the myStateBar tab

Click the myProfile tab

Scroll down to the Advanced Profile area

Enter the name(s) of your successor(s)

Check the box to indicate you have reviewed the necessary information and had the appropriate discussions with your successor(s)

Click the Submit Advanced Profile button

In the late 1800’s, a separate bar admission was required to practice before the Wisconsin Supreme Court. Rhoda Lavinia Goodell, a Janesville lawyer, represented a widow in a case that was eventually appealed to the Supreme Court. Her petition to practice before the Court was denied partly due to state statute governing admission to the bar which only contained masculine pronouns.

After her denial, Lavinia then began a campaign to change the state statute governing admission to the bar. The Wisconsin Legislature passed a bill prohibiting denial of admission to the bar on the basis of gender and it was signed into law on March 22, 1877.
