New release: Arbitration and Mediation of
Business Disputes
Business disputes are a fact in every business law practice.
Traditionally, the issue is all too often boiled down
to litigation or surrender. But there is an effective nonjudicial
alternative, described in Arbitration and Mediation of Business
Disputes, published by State Bar CLE Books.
In this book, Attorney Terry Peppard - veteran arbitrator and
mediator and past chair of the
Bar's Alternative Dispute Resolution (ADR) Section - explains how
arbitration and mediation can resolve business
disputes, why such approaches are
often better, and the best form of dispute resolution for each
situation. He also provides practice tips and
identifies common practitioner errors - and how to avoid making them.
Attorney John Dawson, longtime chair of Foley & Lardner's
Milwaukee litigation department,
described the first edition of this book as "more than a simple
`how to,' though the author's practical advice
and commentary throughout will prove invaluable to both novice and
experienced practitioners. Equally helpful
is Peppard's analysis of the policies and purposes of underlying
federal and state legislation, and
the interpretation and application of those statutes by the
courts."
This invaluable guide is now published in a significantly expanded
second edition, incorporated
into the State Bar's Wisconsin Business Advisor
Series.
In the second edition Peppard discusses additional arbitration
issues, including attorney fees,
discovery limits, and clarification of awards. He also discusses
mediation issues such as crucial attributes of an
effective mediator, the ethics of advocating mediation, the key
provisions of mediation settlement agreements, and
the role of equitable estoppel.

Uniform Mediation Act, ethics codes for
arbitrators and mediators, and a table of commonly used acronyms.
