OLR Hearing to Reinstate John Hotvedt

Oct. 21, 2020 – On Dec. 15 and 16, 2020, commencing at 9 a.m., at the Milwaukee Bar Association,747 N. Broadway (Broadway Room #1), Milwaukee, a public hearing will be held before referee Kim Marie Peterson on the petition of John Hotvedt, Burlington, to reinstate his Wisconsin law license. Any interested person may appear at the hearing and be heard in support of or in opposition to the petition.

If the hearing cannot be held in person due to Covid-19 restrictions, it will be held by remote videoconference at the date and time set forth above. Any person wishing to testify at or merely watch the proceeding will be given access via videoconference.

In 2016, the Wisconsin Supreme Court suspended Hotvedt’s Wisconsin law license for 18 months for misconduct that involved dishonesty, fraud, deceit or misrepresentations, breach of fiduciary duties to his law firm, and failure to cooperate in an Office of Lawyer Regulation (OLR) investigation. Disciplinary Proceedings Against Hotvedt, 2016 WI 93.

To be reinstated, Hotvedt has the burden of substantiating by clear, satisfactory, and convincing evidence that 1) he has the moral character to practice law in Wisconsin, 2) his resumption of the practice of law will not be detrimental to the administration of justice or subversive of the public interest, 3) all of his representations in his reinstatement petition are substantiated, and 4) he has complied fully with the terms of the order of suspension and with SCR 22.26.

Relevant information (including instructions to attend the videoconference hearing) can be provided to or obtained from OLR assistant litigation counsel John T. Payette, 110 E. Main St., Suite 315, Madison, WI 53703; email john.payette@wicourts.gov.
