<p style="margin-top: 0; margin-bottom: 7px;">Have you ever taken your car to a certain repair shop because your friends all do business there? If you answered “yes,” you’re not alone. It seems like common sense to ask people you trust for recommendations on where to get your car repaired. However, this is also a classic example of Bandwagon Effect, a form of cognitive bias.
</p><p style="margin-top: 0; margin-bottom: 7px;">Falling prey to cognitive bias is perfectly natural and something we all do. In fact, cognitive bias can assist us in our daily lives. According to <em>Psychology Today</em>, some sociologists believe cognitive biases help us process information more quickly, meet our most basic needs, and connect with others.<sup style="font-size: 12px; line-height: 0; ">1</sup></p><p style="margin-top: 0; margin-bottom: 7px;">When it comes to practicing law, however, cognitive bias can interfere with logic and objective decision-making. Recognizing these biases is the first step to reducing their power over your thinking. Some of the most widespread cognitive biases include:</p>
<ul style="margin-top: 0; margin-bottom: 7px;">
<li><strong>The Affect Heuristic</strong> – occurs when you insert your feelings of like or dislike into decision-making. For instance, each lawyer usually likes their own client better than the opposing client, leading to an exaggerated belief in the likelihood of success. </li>
<li><strong>Confirmation Bias </strong>– what happens when you seek out information that conforms to your pre-existing beliefs and ignore anything else. </li><li><strong>Clustering Illusion</strong> – seeing random events that occur in clusters as related events or patterns. </li>
<li><strong>Just-World Phenomenon</strong> – the belief that the world is fair and people get what they deserve, leading you to look for ways to rationalize injustice (i.e., victim blaming). </li><li><strong>Causation Bias</strong> – a tendency to assume a cause-effect relationship in situations in which none exists. For example, believing someone is angry with you because they haven't responded to your email when they’re more likely just busy and simply haven't gotten to it yet. </li><li><strong>Fundamental Attribution Error</strong> – occurs when we attribute other people's behavior to their personalities and attribute our own behavior to the situation. It goes something like this: When someone treats you poorly, you probably assume they are a jerk, but when you're not nice to someone, it's because you are having a bad day.</li></ul>
<p style="margin-top: 0; margin-bottom: 7px;">Comprehending the cognitive biases to which we’re all prone can help you better understand not only yourself, but also judges, jurors, witnesses, clients, and opposing counsel.
