    August PINNACLE Institute Focuses on Health, Labor, and Employment Law

    Jim DoyleJune 20, 2012 – Former Gov. Jim Doyle is the keynote speaker for the August State Bar of Wisconsin PINNACLE® Health Law and Labor & Employment Law Institute. The Aug. 23-24 program in Wisconsin Dells includes more than 12 breakout sessions, five plenary sessions, and a luncheon program. The program kicks off at 8 a.m. on Thursday and ends at 12:15 p.m. on Friday.

    Connect with your colleagues over lunch on Thursday before hearing former Gov. Jim Doyle speak about the politics associated with health care reform in light of the U.S. Supreme Court’s decision (which is expected this summer) on President Obama’s Health Care Reform Act. He will also address the national November 2012 elections and what it means for Wisconsin.

    Plenary Sessions

    Working in the Bermuda Triangle of Leaves: Worker's Compensation, ADA and FMLAPresenter Robert K. Sholl, Reinhart Boerner Van Deuren S.C., will discuss topics of interest surrounding a worker’s comp, FMLA, or ADA-related leave of absence, such as reinstatement, types of medical information an employer can request, and how long employees may take leave and not lose their jobs

    What Keeps You Up at Night/When the Government Knocks – A panel will examine topics of significant interest and impact to those serving in in-house counsel roles such as DOJ investigations; qui tam relators/whistleblowers; handling technical Stark violations; HIPAA audits/privacy compliance; EHR conversions & meaningful use; Recovery Audit Contractors (RAC) audits; predictive modeling/frozen payments; physician transactions without proper legal review, e-discovery and records management; issues regarding pharmaceutical and other vendors; health care reform impact; ICD-10 readiness; social media issues; OFCCP audits; and wage and hour class action lawsuits.

    Panelists include: Marybeth Herbst-Flagstad, Forest County Potawatomi Community; Carrie N. Killoran, Aurora Health Care; Christine C. Duval-Senty, Dean Health Plan Inc; Stacie J. Andritsch, Wheaton Franciscan Healthcare; and Amy L. Marquardt, Hospital Sisters Health System.

    Labor & Employment Law and Case Update: Year-In-Review Michael M. Bamberger, Beck, Chaet, Bamberger & Polsky S.C., and Daniel A. Kaplan, Foley & Lardner LLP, will provide an overview of critical case decisions and pieces of legislation occurring in the past year in the labor and employment and health law fields.

    Social Media in the 21st Century: Practice Tips from an Employer and Employee Perspective Jina L. Jonen, Wisconsin Education Association Council Legal Department, and Judith A. Williams-Killackey, Quarles & Brady LLP, will focus on recent legal issues arising out of social media and how they impact employers, employees, and unions.

    Regulatory Aspects of Physician Employment Thomas Shorter, Godfrey & Kahn S.C., will focus on the unique regulatory aspects of employing physicians in Wisconsin, including issues implicated by the Corporate Practice of Medicine Doctrine, the Ethics in Patient Referrals Act (Stark Law), the Antikickback Statute, and the Health Care Quality Improvement Act. The presentation will include discussion on how the health care regulatory provisions affect compensation, noncompetition clauses, bonuses, and discipline of physicians.

The institute is included in the cost of the State Bar of Wisconsin Ultimate Pass®. Members can earn up to 11 CLE credits. Institute hours are Thursday, 8 a.m. - 4:30 p.m. and Friday 8:30 a.m. - 12:15 p.m.
