Final Order: Petition 14-07 Electronic Banking Procedures for Lawyer Trust Accounts
The Office of Lawyer Regulation (OLR) filed this rule petition asking the court to amend and/or recreate the trust account rule and several related rules, specifically Supreme Court Rules (SCRs) 20:1.0, 20:1.5, 20:1.15, and 22.39. The OLR asserted that this petition came in response to the increased use of electronic banking and diminishing use of paper checks, which makes it harder for lawyers to comply with trust account rules as currently written and harder for the OLR to monitor and investigate compliance with the rule.
Final Order Issued: April 4, 2016
Dispositions: The amended, recreated, and new SCRs are effective July 1, 2016. The Comments to the SCRs are not adopted, but will be published and may be consulted for guidance in interpreting and applying the rule.
The amendments to SCR 22.39 and new SCRs 20:1.15(e)(4), (g)(3), and (k)(9) shall apply to proceedings commenced after the effective date of this rule and, insofar as is just and practicable, to proceedings pending on the effective date.
The amendments to SCR 20:1.0(ag) and (dm), and new SCRs 20:1.5(f) and (g), and all provisions of new SCR 10:1.15, except for 20:15(e)(4), (g)(3), and (k)(9), shall apply to conduct occurring after the effective date of this rule.
