Upon request, a lawyer should promptly surrender the file to a client or successor counsel upon termination of the representation. The lawyer may not retain the file to encourage payment of outstanding fees or costs, or charge the client for copying the file.
The new rule, with an expected effective date of July 1, 2017, will allow lawyers who mediate family law cases to draft, modify, complete, and file settlement documents. The rule will give divorcing couples more affordable options to come to a resolution.
