    Top Legal Developments in Health Law – C. Frederick Geilfuss II, Foley & Lardner LLP, will discuss the HIPAA Final Omnibus Rule to the Privacy and Security Regulations, Physician Payment Sunshine Act, and Provider Self-Disclosure Protocol.

    Labor Law and the National Labor Relations Board: Where Do We Go From Here? – Dean R. Dietrich, Ruder Ware L.L.S.C., and Nathan D. Eisenberg, The Previant Law Firm S.C., will discuss the D.C. Circuit's recent decision in Noel Canning v NLRB, concerning recess appointments to the National Labor Relations Board, which overshadows recent decisions issued by the Board itself.

    De-Mystifying the “Bermuda Triangle” – Patricia A. Lauten, Madison City Attorney's Office and Rebecca L. Salawdeh, Salawdeh Law Office LLC, will discuss the triangular intersection of the ADA, FMLA, and Worker’s Compensation.

    “BAA” Humbug: Business Associate Agreements of the Future – Angela M. Rust, Hinshaw & Culbertson LLP, will explore new requirements under the Omnibus Final Rule for BAAs between covered entities, business associates, and subcontracting business associates.

    Broad Name, Narrow Rule: Common-Law Wrongful Discharge in Wisconsin – Jeff Scott Olson, The Jeff Scott Olson Law Firm S.C., will address Wisconsin's common-law doctrine of wrongful discharge.

    ACOs: Status, Timelines, and Compliance Issues – Panelists Gwendolyn J. Cooley, Wisconsin Department of Justice, Joel Jaglin, PwC, and Paul T. Van Den Heuvel, Marshfield Clinic will explore the progress and practical and legal hurdles to establishing accountable care organizations both inside and outside the Medicare Shared Savings Program created under the Affordable Care Act.     Buying and Selling a Medical Practice: A Transactional Perspective – Adam J. Tutaj, Meissner Tierney Fisher & Nichols S.C., will review the common business, tax, and regulatory considerations associated with the purchase and sale of professional medical practices.

    Peacefully Ending the Employment Relationship: Negotiating Thorough, Enforceable and Sustainable Separation Agreements – Peter J. Fox, Fox & Fox S.C., and Frank A. Gumina, Whyte Hirschboeck Dudek S.C., will examine ending the employment relationship issues from the perspectives of a management lawyer and an employee lawyer.

    Evolution of Provider Compensation in a Post-PPACA World – David J. Edquist, von Briesen & Roper S.C., and Thomas N. Shorter, Godfrey & Kahn S.C., will discuss key concepts and developments in analysis of physician compensation, pay-for-performance, and waivers for PPACA shared savings programs.

    What are Institutes?

    In 2011, State Bar of Wisconsin PINNACLE began producing several multiday CLE institutes. These events feature focused, highly relevant CLE programming in two to four areas of practice. They may include a vendor/exhibitor expo hall and social events. Some of these institutes will be held at destination locations, such as resorts.

    How to Register

    Tuition, not including Thursday’s luncheon and CLE program, is $379 for members; $189.50 for Emeritus State Bar members and Ultimate Pass Silver subscribers, and is included in the cost of the Ultimate Pass Gold subscribers. The ticketed Thursday CLE, College Athletes’ Biggest Health Risk: The NCAA?, program and luncheon cost an additional $20.     Register before July 22 to receive special room rates at the Kalahari Resort. Discounted room rates are: Wednesday and Thursday, Aug. 21 and 22 –  $129; Friday, Aug. 23 – $149; Saturday, Aug. 24  – $169; and Sunday, Aug. 25 - $129.

    CLE Credit 

    Institute sessions will be submitted for up to 11.5 CLE credits. Select sessions will be recorded and webcast at a later date. All Institute attendees can attend the first two replay dates at no additional charge.
