A 4-3 Wisconsin Supreme Court majority affirmed the circuit court’s dismissal of a lawsuit, seeking enforcement of restrictive covenants against the Menominee Indian Tribe, because the Tribe retains sovereign immunity.

A delay in one examiner’s report for an involuntary commitment final hearing did not defeat the circuit court’s competency because the protection was not “central to the statutory scheme.”

Although the circuit court later extended the 2023 recommitment order, collateral consequences allowed the Wisconsin Supreme Court to determine any error the circuit court arguably made was harmless.
