    Hearing to Reinstate James M. Schoenecker

    A public hearing will be held on the petition of James M. Schoenecker of Elm Grove to reinstate his Wisconsin law license.

    April 3, 2019 – On Tuesday, June 18, 2019, commencing at 9:00 a.m., and continuing into June 19-20 if necessary, a public hearing will be held before referee James J. Winiarski at the Milwaukee Bar Association, 747 N. Broadway, Milwaukee, on the petition of James M. Schoenecker of Elm Grove to reinstate his Wisconsin law license. Any interested person may appear at the hearing and be heard in support of or in opposition to the petition.

    In 2011, the Wisconsin Supreme Court suspended Schoenecker’s law license for three years for misconduct that involved: conflict of interest; charging excessive fees; criminal conduct; dishonesty, fraud, deceit or misrepresentation; failure to obey a court order; breach of fiduciary duties; and other misconduct.     In 2016, the Wisconsin Supreme Court suspended Schoenecker’s law license for an additional one year for misconduct that involved dishonesty, fraud, deceit or misrepresentation.  Disciplinary Proceedings Against Schoenecker, 2016 WI 27.

    In January 2017, Schoenecker petitioned for reinstatement of his law license. Following a hearing and an appeal, the Supreme Court denied the petition on May 25, 2018. Disciplinary Proceedings Against Schoenecker, 2018 WI 58.

    To be reinstated, Schoenecker has the burden of substantiating by clear, satisfactory, and convincing evidence that 1) he has the moral character to practice law in Wisconsin; 2) his resumption of the practice of law will not be detrimental to the administration of justice or subversive of the public interest; 3) all of his representations in his reinstatement petition are substantiated; and 4) he has complied fully with the terms of the orders of suspension and with SCR 22.26.
