Inside the Bar December 2005: Bar seeks examples of unauthorized practice of law by Dec. 31

The date is fast approaching for members to submit examples of how the unauthorized practice of law (UPL) has harmed the public. The State Bar UPL Policy Committee seeks examples of UPL for inclusion in a petition to be filed with the Wisconsin Supreme Court in 2006. Members who have personal knowledge, or who have clients who have knowledge, of instances of nonlawyers practicing law, are urged to report the facts and circumstances to the committee by Dec. 31.

In 2003, the State Bar petitioned the supreme court to appoint a committee to develop a proposed supreme court rule defining the practice of law and creating a system for administering the new rule. On Feb. 28, 2005, the court rejected the petition, in part because the petition did not include examples demonstrating that the lack of a definition is detrimental to the public interest. The court asked the State Bar to collect evidence of instances in which the UPL harmed members of the public. The court also asked the State Bar to devise a new rule for dealing with the problem.
