CLE Books revises Guardianship and Protective Placement for the
Elderly in Wisconsin
The long-awaited second edition of Guardianship
and Protective Placement for the Elderly in Wisconsin, an
indispensable State Bar CLE Books elder law title, will be released this
month.
Authored by experienced Baraboo attorney Gretchen Viney, associate
director of the Lawyering Skills Program at the U.W. Law School, the
revised book continues to serve as a practical guide to help Wisconsin
attorneys learn and review the basic aspects of guardianship and
protective placement procedures as applied to the elderly.
Although the publication originally grew from materials developed for
a basic "how to" seminar, Guardianship
and Protective Placement now provides expanded guidance on
numerous critical issues. Topics covered include: guardianships of the
person and of the estate; protective services as an alternative to
protective placement; the roles of the petitioner's attorney, guardian
ad litem, advocacy counsel, and guardian; annual reviews of placements;
termination and modification of guardianships and protective placements;
and emergency and temporary procedures.
The book also provides extensive discussions relating to case
preparation and hearings, along with author commentary, practice tips,
and checklists designed to guide elder law practitioners through the
guardianship and protective placement process.
The new edition discusses recent legal developments on various
issues, ranging from guardian ad litem training requirements to attorney
fee awards. While the book remains focused on procedures under chapters
55 and 880 of the Wisconsin Statutes, it also now briefly addresses the
temporary protective placement procedure available under section 51.67
of the Wisconsin Mental Health Act. In addition, the revised edition
reprints dozens of pertinent mandatory court forms and supplies several
author-drafted sample forms for use in guardianship and protective
placement proceedings.
The 200-plus-page, soft cover book costs $29, plus tax, shipping, and
