ARBITRATION AWARD

The above-captioned parties, herein "Association" and "District," are parties to a collective bargaining agreement providing for final and binding arbitration. Pursuant thereto, the undersigned was appointed Arbitrator by the Wisconsin Employment Relations Commission on July 27, 1999, pursuant to the procedure contained in the grievance/arbitration provisions of the parties' collective bargaining agreement to hear and decide a dispute as specified below. Pursuant thereto, hearing was held in Weyauwega, Wisconsin, on September 16, 1999. Pursuant to the parties' request, I there issued a bench decision which this Award confirms.

Based upon my review of the evidence and the respective positions of the parties, I issued the following bench decision on September 16, 1999.

AWARD

1. The answer to the issue as framed by the undersigned is NO, the District did not violate the contract when it failed to offer the overtime in question on Saturday, March 27, 1999, and Saturday, April 10, 1999, to Tom Gill, the Grievant.

2. Based on same, the grievance is denied, and the matter is dismissed.
