ORDER DENYING MOTION TO STAY
On January 12, 2012, the International Association of Fire Fighters, Local 487, filed a motion to stay further proceedings in the above captioned matter until the Wisconsin Employment Relations Commission issued a decision as to a matter remanded to it in Case 11-CV-299 by Circuit Court Judge Lisa A. Stark and until the City of Eau Claire had commenced any appeal from Judge Stark's decision. Local 487 argued that it could not construct a final offer for interest arbitration until the status of the remand and the appeal were known. The parties thereafter filed written argument as to the motion.
On January 30, 2012, the City filed its Notice of Appeal. On February 22, 2012, the Commission issued a decision as to the remand (Dec. No. 33262-A). Thus, as of February 22, 2012, the objections to proceeding to interest arbitration cited by Local 487 in its motion had
been resolved by the action of the Commission and the City. Therefore, on February 22, 2012, we voted to deny the motion to stay. By this Order, we confirm our February 22, 2012 action.
NOW, THEREFORE, it is
The motion to stay is denied.
