On June 21, 2005, Examiner Daniel J. Nielsen issued an Order with Accompanying Memorandum in the above-entitled matter dismissing the complaint for failure to state a claim.

Within the 20-day statutory time period set forth in Sec. 111.07(5), Stats., no petition for review (1) of said Order was filed and no intervening order by the Examiner or the Commission was issued.

NOW, THEREFORE, the Commission issues the following
