NOTICE OF COMMISSION'S FINDINGS OF FACT, CONCLUSIONS OF LAW
AND ORDER PURSUANT TO SECTION 111.07(4), STATS.

On January 18, 2005, Examiner Karen J. Mawhinney issued Findings of Fact, Conclusions of Law and Order with Accompanying Memorandum, in the above-entitled matter determining that Respondent had committed a prohibited practice within the meaning of Secs. 111.70(3)(a)1, Stats. She ordered Respondent to cease and desist from such conduct and to post a notice.

The Examiner further determined that Respondent had not committed a prohibited practice within the meaning of Sec. 111.70(3)(a)4, Stats., and that she would not assert jurisdiction over the alleged violation of Sec. 111.70(3)(a)5, Stats. Therefore, she dismissed those portions of the complaint.

Within the 20-day statutory period set forth in Sec. 111.07(5), Stats., no petition for review of said Findings of Fact, Conclusions of Law and Order was filed and no intervening order by the Examiner or the Commission was issued.

Now, therefore the Commission issues the following

NOTICE

By operation of Sec. 111.07(5), Stats., Examiner Mawhinney's Findings of Fact, Conclusions of Law and Order in the above-entitled matter became the Commission's Findings of Fact, Conclusions of Law and Order on February 8, 2005.

Respondent shall notify the Wisconsin Employment Relations Commission and Complainant within 20 days of the date of this Notice as to what steps have been taken to comply with the Commission's Order.
