ORDER DENYING MOTION TO DISMISS

Waukesha County Technical Educators Association filed objections in the above matter wherein it alleged that the Waukesha County Technical College engaged in improper conduct

which affected the results of an election. Prior to hearing, the College subsequently filed a

motion asking that the objections be dismissed because it did not engage in improper conduct and because even the alleged improper conduct did not affect a sufficient number of employes to impact on the election results.

We have considered the matter and conclude that because material facts are in dispute between the parties, an evidentiary hearing is needed. See Sec. 227.42(1), Stats. Therefore, we have denied the pre-hearing motion to dismiss.
