DECLARATORY JUDGMENT

The above-captioned action having been commenced on October 13, 1993, under sec. 227.40, Stats., for a declaratory judgment as to the validity of WisconsinAdministrative Code §§ERB 33.10(5) and (6); and

Madison Teachers, Inc., and the Sun Prairie Education Association having appeared by Lee Cullen and Richard Thal, Cullen, Westen, Pines & Bach, and the Wisconsin Employment Relations Commission having appeared by David C. Rice, Assistant Attorney General; and

The court having considered the written and oral arguments of the parties; and

The court having decided that Wisconsin Administrative Code §§ERB [now "ERC"] 33.10(5) and (6) do not exceed the Commission's statutory authority,

Now Therefore, IT IS ORDERED, ADJUDGED AND DECREED that Wisconsin Administrative Code §§ERC 33.10(5) and (6) are valid.
