ORDER DENYING MOTION TO CONSOLIDATE

On September 5, 1991 Marathon County filed a Motion to Consolidate six pending interest arbitration petitions into a single Sec. 111.70(4)(cm)6, Stats. proceeding, asserting that there is a sufficient similarity of issues and parties to warrant such action by the Commission.

On September 17, 1991, the collective bargaining representative of the employes in the six bargaining units covered by the petitions filed a statement opposing the Motion. The representative denied the County's contention that there is sufficient similarity of issues in the six pending interest arbitration proceedings before Investigator Yaeger. The representative further asserted that even if there were a similarity of issues, the bargaining units cannot be compelled to consolidate the petitions.

On September 19, 1991, the County reasserted its previous contentions as to similarity of parties and issues and on September 24, 1991 the collective bargaining representative reponded thereto.

The Commission has considered the matter and concluded that although petitions can be voluntarily consolidated under Sec. 111.70(4)(cm)6, Stats., said statutory provision entitles the parties to a collective bargaining relationship to a separate interest arbitration proceeding for each bargaining unit even if there is an identity of parties and issue(s);

NOW, THEREFORE, it is

ORDERED

That the Motion to Consolidate is denied.
