PROPOSED STIPULATION AND ORDER

STIPULATION

The undersigned parties hereby request the Court to stay all proceedings in this matter pending resolution by the Wisconsin Supreme Court of Browne, et at. v. Wisconsin Employment Relations Commission, Case No. 89-1094. Argument on that case is to be scheduled as soon as possible after the United States Supreme Court issues its decision in Lehnert, et al., v. Ferris Faculty Ass'n, 881 F.2d 1388 (6th Cir. 1990), cert. Granted 110 L. Ed. 637, which decision is expected by the close of the present term.

Virtually all of the issues raised by the Petitioners have also been raised in Browne. In order to preserve the Court's and the parties' resources, the parties hereby request that this Court stay all proceedings until thirty (30) days after the Wisconsin Supreme Court issues its decision in Browne. Counsel for the Wisconsin Employment Relations Commission hereby agrees to provide the Court with a copy of said decision.

ORDER

Based on the stipulation of the parties, the Court hereby orders all matters relating to Hewitt, et al. v. Wisconsin Employment Relations Commission, to be held in abeyance until thirty (30) days after the receipt of the Wisconsin Supreme Court decision in Browne v. Wisconsin Employment Relations Commission.
