DECISION AND ORDER

The Court, having determined that a proceeding brought before the Respondent, Wisconsin Employment Relations Commission, and entitled Milwaukee Teachers Education Association v. Milwaukee Board of School Directors, Case No. 194 No. 38540 DR (M)-426 was not ripe for adjudication and further having determined that the Respondent acted in excess of its authority by having interpreted and determined matters of Federal Constitutional dimensions (all as more fully set forth in its Memorandum Decision dated September 5, 1990); now, therefore

IT IS HEREBY ORDERED AND ADJUDGED:

That the determinations of the Respondent, Wisconsin Employment Relations Commission, issued in conjunction with the above-referenced proceeding, more particularly, Decision No. 24748 (dated September 17, 1987) and Decision No. 24748-A (dated April 3, 1989) are hereby VACATED and REVERSED in their entirety pursuant to sec. 227.57, Stats.
