ORDER FOR JUDGMENT AND JUDGMENT

On December 1, 1989, pursuant to the Court's request, the above named parties appeared before the Court in open session by their counsel, the petitioner by Attorney Bruce Ehlke, the Wisconsin Employment Relations Commission by Attorney David Rice, and Chippewa County by Attorneys Joel L. Aberg and Stephen L. Weld, for the purpose of providing the Court with oral argument in the above-referenced matter. Upon review of the documents on file with the Court and briefs by the parties, and after hearing the argument of counsel, and being fully advised in the premises,

IT IS HEREBY ORDERED that judgment should be entered affirming as written the Wisconsin Employment Relations Commission's Decision No. 24521-B in its Case 136, No. 41165, MP-2145, because no statutory grounds for setting aside, modifying, remanding or ordering agency action.or ancillary relief under a specified provision of s. 227.57, Wis. Stat., has been shown by the petitioner. Judgment shall be awarded without costs to any party except the law firm of Mulcahy & Wherry, S.C. is assessed a penalty of $50-00 which shall be payable to the Clerk of Court consistent with the Court's bench decision in this matter.

JUDGMENT

Pursuant to the foregoing Order of the Court,

IT IS HEREBY ADJUDGED AND DECREED that Wisconsin Employment Relations Commission Decision No. 24521-B, Case 136, No. 41165, MP-2145 is affirmed in all respects for the reasons set forth in the Court's bench decision and in the foregoing order of the Court. The law firm of Mulcahy & Wherry, S.C., shall pay to the Clerk of Court the sum of $50.00 as a penalty. No other costs, fees or assessments shall be awarded to any party.
