ORDER

The above entitled proceeding having been commenced January 13, 1988, under Wis. Stats. Sec. 111.07(8) and ch. 227, to review a decision of the Wisconsin Employment Relations Commission under the Municipal Employment Relations Act, Wis. Stat. Secs. 111.07-111.77; and

The petitioner having appeared by Robert M. Hesslink, Jr. , the Commission having appeared by David C . Rice, Assistant Attorney General, and AFSCME Local Union No. 3148 having appeared by Richard V. Graylow, Lawton & Cates, S.C.; and

The court having reviewed the record and the written arguments of the parties; and

The court having entered a memorandum decision on June 1, 1989; and

The court having entered an order on June 28, 1989, affirming the decision of the Wisconsin Employment Relations Commission; and

The court having entered an order on August 8, 1989 vacating its prior order of June 28, 1989 and determining that the Court should proceed to review the decision of the Wisconsin Employment Relations Commission on the merits; and

The court having reviewed that decision on its merits and issued its Decision on October 11, 1989;

Now, Therefore, IT IS ORDERED that the decision of the Wisconsin Employment Relations Commission is REVERSED and the matter is remanded to the Wisconsin Employment Relations Commission with instructions to dismiss the complaint in prohibited practices which was filed by the Local No. 3148 against Sauk County.
