ORDER

The petitioner having moved the Court to vacate the order entered on June 28, 1989, and the matter having been heard by telephone on August 3, 1989, the petitioner, Sauk County, appearing by Attorney Robert M. Hesslink, Jr., the respondent, Wisconsin Employment Relations Commission, appearing by Assistant Attorney General David C. Rice, and the respondent, AFSCME Local Union 3148 appearing, by letter, by Attorney Richard V. Graylow, and the Court having considered the file and the arguments of counsel, IT IS HEREBY ORDERED AS FOLLOWS:

1. The order entered by the Court on June 28, 1989, whereby the court affirmed the decision of the Wisconsin Employment Relations Commission, is vacated; and

2. The Court will proceed to review the arguments of the petitioner's and respondent's on the merits, rather than only on the timeliness issue.
