    Tactics for Dealing With Discovery Abuse

    July 5, 2012 – There are several tactics lawyers can employ to defend against obstreperous conduct from opposing counsel during a deposition or a cross-examination. In this video, Christine Bremer Muggli, Bremer & Trollop S.C., Wausau, discusses what to do when opposing counsel takes a “Rambo” approach and interferes with questions during a deposition or a cross-examination.

    Rephrasing the question may seem to be the obvious answer, but you can do more. Bremer Muggli says it’s wise to know your opponent’s technique beforehand and be sure you know the rules. Perhaps the best way to fight a “Rambo” is on videotape.
