Sept. 1, 2010 — A new law that goes into effect on Jan. 1, 2011, gives the Wisconsin Department of Workforce Development substantial teeth to investigate and address worker misclassification issues involving employers engaged in construction-related services. Such employers can minimize their liability exposure now by analyzing whether they can meet the burden of establishing independent contractor status under the various legal tests, says Attorney Troy Thompson.

Sept. 1, 2010 — A defendant, charged for a crime in Wisconsin, is later arrested and jailed in Illinois based on both Illinois and Wisconsin warrants. Does credit for time served apply to the Wisconsin sentence when the defendant is sentenced to a prison term that runs concurrently with the sentence in Illinois? The Wisconsin Supreme Court said yes in State v. Carter.
