Associate University Legal Counsel – UW-Madison
Official title: ASSOC UNIV LEGAL CNSL(T52FN)

Degree and area of specialization: Juris Doctor

License/certification: Membership in good standing in the Wisconsin State Bar or admission to the Wisconsin State Bar within one year of hire date.

Minimum number of years and type of relevant work experience: Minimum two (2) years' legal experience. Preferred qualifications include experience in advising higher education institutions and/or a demonstrated interest in higher education issues.

Individual must have effective oral and written communication skills, ability to work collegially and the capability and willingness to serve as a creative thinker and problem solver to complex and novel problems.

Principal duties:

Position Summary: UW-Madison, the flagship campus of the University of Wisconsin System, is a research-intensive University serving approximately 41,500 students and employing over 16,000 FTE faculty and staff members. The Office of Administrative Legal Services (OALS) is comprised of nine in-house attorneys who provide advice and counsel to the UW-Madison campus community.

The duties of the two positions include rendering oral and written advice on a broad array of complex and novel legal subjects to the Chancellor, Provost, Deans, and other administrators, faculty and staff. The positions require the ability to analyze legal problems, conduct legal research and make written and oral presentations.

One of the positions primarily will be responsible for providing advice and counsel in the following areas and the start date will be approximately December 15, 2009:

Employment law: This includes, but is not limited to, advising on classified civil service, academic staff and faculty policies/procedures, state and federal employment-related laws and academic staff and faculty governance; representing the interests of the UW-Madison before administrative bodies such as the Wisconsin Employment Relations Commission, the Equal Rights Division and the Unemployment Compensation Division of the Department of Workforce Development and the federal government¿s Equal Employment Opportunity Commission and Office for Civil Rights; serving as a liaison with the Assistant Attorneys General in the Department of Justice in court litigation.

Medical Malpractice/Risk Management: This includes serving as risk manager to more than 1,000 University medical professionals; providing advice, education and counsel regarding health law issues and serving as liaison with the Assistant Attorneys General in the Department of Justice in court litigation.

The individual also will advise on student disciplinary matters and be required to maintain a generalist practice to provide advice and counsel on various other higher education legal issues including public records, open meetings FERPA, subpoenas, and contracts.

The other position primarily will be responsible for providing advice and counsel in the following areas and the start date will be in January 2010:

The successful candidate will be working with two other attorneys, primarily in the transactional and research areas. Duties in the transactional area may include, but are not limited to, advising campus units on matters related to public procurement, tax, and other business operations. Duties related to the University research enterprise may include, but are not limited to, drafting or advising on research policies; negotiation of research agreements; advising various research committees (such as the Animal Care and Use Committee and the Biosafety Committee) about State and Federal laws and institutional policies; and handling issues involving sponsored research and grants, intellectual property, and conflicts of interest.

The individual also will be required to maintain a generalist practice to provide advice and counsel on various other higher education legal issues including public records, open meetings FERPA, subpoenas and contracts.

A criminal background check will be conducted prior to hiring. A period of evaluation will be required
