Description

Smaller and medium businesses are the greatest generators of growth and employment in the economy, and are the companies most easily subject to reversals when the economy slows.  In the current environment of slowing economic growth and very tight credit, many businesses are seeking alternatives to filing for bankruptcy in the hope of remaining viable until broader economic trends turn.  This program will provide you a guide to practical techniques a business can use, short of filing for bankruptcy, to maintain liquidity/operating capital, work to satisfy creditors, suppliers and others, and maintain operations during difficult economic times. 

  • Working with lenders on liquidity, loans and other issues
  • Assignments in favor of creditors
  • Capital structure issues and opportunities for clean-up
  • Modification of agreements with suppliers and others
  • Special real estate issues

About the Speakers . . .

Mark E. Leipold is a partner in the Chicago office of Gould & Ratner, LLP, where his practice focuses on representing lenders, creditors, debtors, trustees and others in sophisticated bankruptcy proceedings and workouts.   His practice includes complex commercial litigation, including fraudulent transfer and preference litigation. Mr. Leipold’s practice also emphasizes asset-based lending and other secured transactions.  He has lectured widely on bankruptcy, creditors’ rights and UCC topics and is an Adjunct Professor of Law at DePaul University, where he lectures on secured transactions.  He is active in the Turnaround Management Association and the American Bar Association.  He also is a member of American Bankruptcy Institute.  Mr. Leipold served as a contributing author to Bankruptcy: Text Statutes, Rules, (Ginsberg, R. & Martin R. 4th Ed.)  (Aspen Law & Business) and the Bankruptcy Law Letter (1991) (Warren Gorham Lamont).  Before entering private practice, he served as a law clerk to the United States Bankruptcy Court for the Northern District of Illinois.  He received his B.S. from Northwestern University and his J.D. from DePaul University College of Law.
