Dairy loss cases can be complicated because the business of milking
cows is complicated. "Alternative cause" theories usually
abound. Out-of-pocket expenses can be large. Analyzing Dairy Loss
Claims: Is the Case Worth Pursuing? offers a framework for making
the decision to take on such a case, with an eye toward its development
and ultimate settlement or trial.
Livestock damages can be even more complicated to estimate. And there
are many opportunities for the use of different calculations to
determine the amount of losses. In addition, there are several court
decisions, which seem to limit the recovery of damages beyond the market
value - disregarding the "loss of use" of the animal(s) and
the reduced profitability that accompanies such a loss.
In cases involving damage to livestock, it's imperative to present
the total economic impact of these losses. You must be able to
not only show these losses, but also support these estimates
with solid information. Find the practical guidance you need on
gathering information, calculating the value and lost profits of
livestock, and supporting your "loss of use" calculations.
